Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Among other methods, one feasible and acceptable method to correct this hazard is:....... a)Melting Department, North Cupola - On or about 10/27/04, the hook on the gantry crane did not have a safety latch. b)Melting Department, North Cupola - On or about 10/27/04, the safety latch on the hook on the man-lifting crane was damaged. Or in the alternative, Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: Among other methods, one feasible and acceptable method to correct this hazard would be the installation of a safety latch on the hook as recognized in 1910.181(j)(2)(ii) which states "Safety latch type hooks shall be used wherever possible." Also to comply with the requirements of the American Society of Mechanical Engineers Standard ASME B30.10-1993, Hooks, Section 10- 1.1.1.2(b).
