Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck-by forklift and pallet jack batteries resulting in crushing injuries to the feet and legs: (a)Battery Charging Room - 1 Ton Electric Chain Hoist - Hoisting Forklift and Pallet Jack Batteries - On or about 05/11/2004, the hook opening was stretched excessively and the latch did not close the throat opening. Among other methods, one feasible and acceptable method to correct this hazard is to train users to identify conditions that can effect the safe operation of the hoist, employ an inspection program to identify and correct the hazards, and replace the hook.ce
