Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: The two battery compartments on the Caterpillar 955 bulldozer operated by city maintenance employees at the Browns Valley landfill did not have a means to secure the batteries in place, therefore, operational movement of the bulldozer caused faulty battery connections and leading the starter to continually engage, and the battery connections to arch.
