Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard, an unattended rough terrain forklift, and inadequate training: Elevated work platforms used with Rough Terrain Forklift Trucks as designated by the manufacturer did not meet the design, construction, and use requirements as outlines by American National Standard Institute ASME/ANSI B56.6-2002 Safety Standards for Rough Terrain Forklift Trucks, Section 5.15.1(s): a trained operator was not in position to control the rough terrain forklift, or available to operate controls if the platform is not equipped with controls. ASME/ANSI B56.6-2002, Section 5.16.1: Operators of a rough terrain forklift truck were not qualified as to a visual, auditory, physical, and mental ability to operate the equipment safely according to para. 5.17 and all other applicable parts of Section 5. ASME/ANSI B56.6-2002, Section 8.24.1(l): Restraining means such as guardrail or a means for securing personnel such as a body belt or lanyard were not being utilized. (a)On July 28, 2004, an employee/operator was positioned the JCB Loader, climbed the stairs and worked off the platform, however, there was no employees/operators in position to control the rough terrain forklift, or available to operate controls if the platform is not equipped with the controls (b)On July 28, 2004, employees were operating a JCB Loader without formal training to educate the employees on the needed visual, auditory, physical, and mental ability required to operate the equipment properly. (c)On July 28, 2004, employees were exposed to a fall hazard approximately 15-16 feet to ground with no type of fall protection in place. (d)On August 17, 2004, an employee was exposed to a fall hazard approximately 10'-3" to ground with no form of fall protection in place. Among other methods, feasible and acceptable means to correct these hazards are to use a safer alternate method such as using fall protection approved by the manufacturer meeting the requirements of ASME/ANSI B56.6-2002 providing formal training to the employees authorized to operate the rough terrain forklifts, and ensuring employees are less than 25 feet from the truck and the rough terrain forklift remains in his view.
