North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)Scalehouse - There were two battery chargers being used to charge batteries in a room where employees smoked. There was an ashtray with many cigarette butts on the same table with the battery chargers. The batteries being charged were 12 volt, and were used in testing equipment. OR IN THE ALTERNATIVE: 29 CFR 1910.178(g)(10): Smoking was not prohibited in the charging area. Among other methods, one feasible and acceptable abatement method to correct this hazard is to prohibit smoking in the battery charging room.ing
