North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)facility wide -- upper limit switches on overhead hoists were not being tested before each operator's shift. REFERENCE:ANSI B30.11-1998, Section 11-2.2, Testing, Paragraph 11-2.2.1, Operational Tests. NOTE:Among other feasible and acceptable methods of abatement of this hazard is to test each upper limit switch before each operator's shift. OR IN THE ALTERNATIVE: 29 CFR 1910.179(n)(4)(i): At the beginning of each operator's shift, the upper limit switch of each hoist shall be tried out under a no load condition.
