Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees in that they were exposed to: Being thrown from dockplates as trucks pull away from the dockplates: a)On the loading and unloading platforms. Employees working on dockplates involved in the loading and unloading of trucks were exposed to injury as a result of being thrown from the dockplates as trucks have pulled away unexpectedly, on or about 3/19/02 through 5/22/02. Abatement Note: One feasible means of abatement would be to follow "Brooklyn GMF Standard Operating Procedures for Loading/Off-Loading Vehicles From Platform" dated March 2, 2001, which states that once the truck has been loaded/emptied, the gate should be closed and locked, an the bay doors should also be closed before the engine is started. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.0
