Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard of more than 15 feet when working on top of the rail cars. a.Establishment, Yard Area: Employees are required to work on top of rail cars without fall protection when unloading wood pallets. Abatement Note: One feasible and acceptable means of abatement would be to install and require the use of a fall protection system while employees area on top of the rail cars.
