North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to injury by an unmaintained machine (Ref: para 5.1.4 ANSI B11.3-1982): a)building #2-there were no scheduled inspections or records of inspections for a Wysong model #3596 35 ton press brake or an Adira model QHA-6025 70 ton hydraulic up-acting press brake (ref: para 5.1.4 ANSI B11.3-1982). One feasible means of abatement is to establish an viable inspection and maintenance schedule for the machinery.
