Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls and crushing injuries from the buckets of the frontend loaders: (a)At the APAC Asphalt Plant site - Decatur, Alabama - Wheeled frontend loaders - On or about 01/04/2002, workers were lifted in the buckets of frontend loaders to gain access to higher working levels. Among other methods, one feasible and acceptable method of abatement would be to provide and enforce the use of ladders and or mobile scaffolds where gaining access to higher working levels is required.
