Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck-by hazards from the use of an improperly operated and maintained hoist: At the worksite at Canal & Line Streets in Leesburg, FL, employees working on a tower to install new antennas were utilizing an improperly operated and maintained hoist. 1.The rated load capacities, recommended operating speeds, special hazard warnings or other instructions was not posted at the hoist in the lifting system. The operating manual developed by the manufacturer for the particular hoist being used was not available for the hoist operator at his station. 2.A log book for the hoist used to record all hoist inspections, tests, maintenance and repair was not maintained at the site. 3.A fire extinguisher of 5BC rating or higher was not available at the hoist operator station. Among other methods, feasible and acceptable means to abate this violation include but are not limited to: following the industry recognized standards as stated in The American Society of Mechanical Engineers "ASME B30.7-1989 Base Mounted Drum Hoists", as well as OSHA Directive CPL 2-1.29, "Interim Inspection Procedures During Communication Tower Construction Activities", and the NIOSH ALERT, DHHS Publication No. 3001-156 "Preventing Injuries and Deaths From Falls During Construction and Maintenance of Telecommunication Towers, July 2001", and to: 1.Obtain the written instructions from the hoist manufacturer or, in the absence of this literature, obtain the written instructions of a registered professional engineer with a specialization in this field of expertise. Ensure that the applicable instructions and operating rules are posted at the hoist operator's station. 2.Maintain a log book at the site for the hoist that's used to record all hoist inspections, tests, maintenance and repair. 3.Ensure that a fire extinguisher of 5BC rating or higher is available at the hoist operator station.
