Text For Citation: 01 Item/Group: 002 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: 933 Mulberry Street, Kansas City, MO 64101; The employer did not have operating procedures instructing employee(s) working at or near the Femco CNC Lathes to stay out of the danger zone while the machine is in operation, as specified in the Manufacturer's Operator's Manual. On or about August 30, 2001 an employee was fatally injured when he was struck by a retaining cover which was projected outward from the machine after being struck by a rotating workpiece which came unclamped from the work-holding device. One feasible and acceptable method of abatement, among others, is to demarcate the danger zone and establish, communicate and enforce a work policy requiring employees to stay out of the danger zone while the machine is in operation. Abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included in your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
