North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)facility, country ham department -- a 1/2 ton wire rope lever hoist was damaged and not removed from service until repaired or replaced. REFERENCE:ANSI B30.21-1993 NOTE:Among other methods, one feasible and acceptable method of abatement of this hazard is to remove the hoist from operation and have it repaired or replaced.
