Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to trailers breaking loose from the vehicles towing them which could result in the trailers striking someone or causing a vehicular traffic accident: (A)Safety inspections were not done on trailers before or after each use. (B)C & B Quality Trailer Works Trailer SN 1G9UC122N075378 was not equipped with adequate safety chains at the time it was involved in an accident in July 2001. (C) C & B Quality Trailer Works Trailer SN 1G9UC122N075378 was not equipped with a breakaway braking system at the time it was involved in an accident in July 2001 nor had one been added prior to the inspection. Among other methods, one feasible and acceptable abatement method to correct this hazard is to conduct a safety inspection of the trailers, including couplers, tires, safety chains and brakes before or after each use of the trailers and not allow the trailers to be used until all safety equipment is in good working condition.
