Text For Citation: 01 Item/Group: 002 Hazard: CRUSHING
P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed by a powered industrial truck in the event of turnover: A) Parked flatbed trailer out front - An employee was operating a Linde Forklift, Model H45D, S/N H2X352N0155345, without wearing the seat belt. B) Parked flatbed trailer out front - An employee was operating a Linde Forklift, Model H60D, S/N 353H12004560, without wearing the seat belt. C) Parked flatbed trailer out front - An employee was operating a Linde Forklift, Model H45D, S/N H27352N0076645, without wearing the seat belt. Among other methods, one feasible and acceptable method to correct this hazard would be to instruct employees to utilize seatbelts during operation of powered industrial trucks and implement a company disciplinary/enforcement policy to ensure compliance.
