P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by falling debris while working and walking around buildings that were breaking apart: a) Bleach Plant - The building housing the bleach plant was observed to be breaking apart, exposing employees to the hazard of being struck by falling building parts such as but not limited to bricks, concrete, and glass, on or about 09/25/2002. b) Pale Size Building - The building housing the two tanks was observed to be breaking apart, exposing employees to the hazard of being struck by falling bricks and/or beams, on or about 09/25/2002. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: To follow company engineer recommendations and perform the necessary repairs to these buildings by replacing and/or repairing the collapsing brick walls, beams, and windows.ng
