Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: On March 07, 2000, an employee was exposed to a fall hazard of 9 feet 5 inches, while performing roofing work, from a personnel platform attached to the forks of a Caterpillar TH63 Rough Terrain forklift that was telescoped out approximately 10 feet. The employee was not wearing any personal fall arrest equipment. The personnel platform was not designed according to the specifications stated under ASME B56.6-1992 for use as a personnel platform with proper guardrails or an engineering certificate with information regarding maximum load, empty platform weight, or minimum capacity of the forklift used. The personnel platform was job made out of 3/4 inch chipboard, 4 feet wide by 8 feet long.
