North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: a)job site - the operator of the Series 500C, Bed# 312-15- 9130 (Hertz) Truck Crane did not have outriggers extended so as to remove weight from the wheels. (ANSI B30.5, Section 5-3.2.1.4 paragraph h.) b)Job Site - The operator of the Series 500C, Bed# 312-15- 9130 (Hertz) Truck Crane did not ensure firm footings for outriggers that were uniformly level within one percent. (ANSI B30.5, Section 5-3.4.6) Among other methods, one feasible and acceptable abatement method to correct this hazard is to move the truck clear of debris and mud. An additional method is the use of blocking and/or cribbing to permit proper extension and footing of outriggers.
