40.1-51.1.(a). Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious harm to employees in that: (a) the manufactures recommendations for the Operator Care Of Truck for the Prime Mover OE 15 C order picker/forklift were not followed, as it relates to removing the truck from service when it is in need of repairs or unsafe for use. The operator noticed a black bar which he felt came from the lift he was operating, he went immediately to the available manager. The manager told the operator that he did not know what the bar was. The manager failed to instruct the operator to take the lift out of service: " ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THIS HAZARD IS TO FOLLOW THE MANUFACTURES RECOMMENDATIONS AS WRITTEN IN THE OPERATING/MAINTENANCE/PARTS MANUAL UNDER OPERATING RULES AND INSTRUCTIONS, "OPERATOR CARE OF THE TRUCK". "IF, DURING OPERATION, THE TRUCK BECOMES UNSAFE IN ANY WAY, THE MATTER SHALL BE REPORTED IMMEDIATELY TO THE DESIGNATED AUTHORITY, AND THE TRUCK SHALL NOT BE OPERATED UNTIL IT HAS BEEN RESTORED TO PROPER OPERATING CONDITION.
