Text For Citation: 01 Item/Group: 002 Hazard: CRUSHING
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)being crushed by or caught between the forklift and the ground in the event of an overturn hazard. The employee operating the Mitsubishi Caterpillar Forklift, model: DP40, Type: D, serial #: 3CM10279, in the old plant, was not wearing the seat belt when the forklift tipped over on July 10, 2000. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train employees and enforce the wearing of seat belts while operating forklifts with a Roll Over Protection System (ROPS) or a Fall On Protection System (FOPS).
