North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were exposed to caught in/under and between hazards: a)rail load out station - employer failed to develop, implement, maintain and train employees on the correct procedures for accessing a moving hopper cars (Reference 49 CFR 214.315(a)) One feasible method of abatement is to develop written procedures for safely accessing a moving hopper car.
