Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the Leach 2RII Packmaster, rear end loaded body that was mounted to a Mack truck: Location: truck routes, Westchester County, NY On or about: 1/24/00-1/27/00 a) The employer did not ensure that the waste disposal truck (Leach 2RII Packmaster, rear end loaded body mounted to a Mack truck, New York commercial license plate number HS1329, company vehicle number G-12), was provided with an operable back up alarm. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: Replace /repair the back up alarm to ensure that it is working properly, as specified in the Leach 2RII Packmaster Operators Manual, Section 5 Operation, Pre-Operation Walk-around Inspection #13, page 5-8. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement of this violation as normally required by 29 CFR 1903.19.
