Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not provide employment and a place of employment which were free of recognized hazards in that employees were exposed to being struck by falling loads from an overhead truck hoist which had not been inspected or rated for capacity. Elevator Building. Employees used the overhead truck hoist (April 2000) to change tanks and dry boxes on the backs of delivery trucks. Periodic inspections of the hoist had not been performed and there was no capacity rating on the hoist or supporting beam. A feasible means of abatement would be to follow the equipment and inspection requirements listed in the national consensus standard of the American Society of Mechanical Engineers, ASME B30.16, 1993, Overhead Hoists (Underhung).
