Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Switching operations - On or about 11/11/99, switch crew members were exposed to the hazards of falling under moving rail cars and crushing injuries when they were continually allowed to perform unsafe work practices: 1) Climbing between moving cars to make cuts. 2) Climbing between moving cars to release hand brakes. 3) Not facing the direction of travel when riding railroad equipment. Among other methods, one feasible and acceptable abatement method would include, but would not be limited to: Enforce switch crew operating rules to include safety requirements as outlined in ACIPCO'S PROGRAM FOR SAFETY manual, Section B, General Yards Department.
