North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: REF:ANSI A39.1a-1988 6.1.2 Manual Boatswain's chairs shall not be used where the height of suspension exceeds 75 ft. a)jobsite; The Addison on East Moorehead - employees were suspended on a manual operated boatswains chair which exceed the allowable height of 75 ft. Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to use a powered boatswains chair when working at heights which exceed 75 feet.
