Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fractures and crushing injuries due to the rollover and/or collision of powered industrial trucks: In the following instances seat belts were not worn by employees operating forklifts on even and uneven surfaces, over crane rails, and in vehicular traffic lanes. Seat belts are a component of an operator restraint system that is designed to reduce the incidence and severity of injuries to the operator in the event of a roll-over or collision: a)Assembly Building - The operator of forklift 651 was not wearing a seat belt and the forklift was not equipped with seat belts. b)Assembly Building - The operator of the Clark forklift was not wearing a seat belt. c)Outside In Yard - The operator of Hyster 80 was not wearing a seat belt and the forklift was not equipped with seat belts. d)Outside In Yard - The operator of the Clark 606 forklift was not wearing a seat belt. e)Outside In Yard - The operator of the Clark 357 was not wearing a seat belt. f)Outside In Yard - The operator of the Hyster 551 was not wearing a seat belt and the forklift was not equipped with seat belts. g)Outside In Yard - The operator of the Hyster 541 was not wearing a seat belt and the forklifts were not equipped with seat belts. h)Outside In Yard - The operator of the Hyster 575 was not wearing a seat belt and the forklift was not equipped with seat belts. i)Outside In Yard - The operator of the Hyster 652 was not wearing a seat belt. j)Outside In Yard - The operator of the YA6 594 was not wearing a seat belt. k)Outside In Yard - The operator of the Hyster 459 was not wearing a seat belt. Among other methods, one feasible and acceptable method to abate this item is to ensure that all Powered Industrial Truck are required with manufacturer approved seat belts and that all operators of such equipment use seat belts.
