NYSLL Article 2, Section 27a(3)(a)(1): The employer did not furnish to each of its employees, employment and a place of employment which was free from recognized hazards that are causing or likely to cause death or serious physical harm to its employees and which will provide reasonable and adequate protection to the lives, safety or health of its employees. In applying this paragraph, fundamental distinctions between private and public sector employment have been recognized: Employees of the NYSTA Canal Corp are exposed to the hazard of electric shock and electrocution during the course of performing maintenance tasks on outlets that have reverse polarity aboard water craft. Reasonable and feasible abatement methods include, but are not limited to, tracing the circuit wiring to determine where the faulty connection was made. (a) NYSTA Canal Corp-The duplex outlet on the aft wall in the galley of the tug boat Waterford had reverse polarity. (b) NYSTA Canal Corp-The GFCI outlet on the ceiling in the galley of the tug boat Waterford had reverse polarity. (c) NYSTA Canal Corp-The outlet on the forward wall in the bunk room of Derrick #4 had reverse polarity.
