Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The structural integrity change of a masonry wall without consulting the Engineer of Record or requesting a reevaluation of the changed masonry wall. Location: 7 Wells/62 Warburton Avenues Yonkers, NY ON OR ABOUT: 04/24/97 & The employer did not inform the Engineer of Record that the details shown on structural drawings to erect steel channels to support an opening in the existing wall could not be used due to changed site conditions. The employer did not request new details and instructions from the Engineer of Record. AMONG OTHER METHODS ONE FEASIBLE AND ACCEPTABLE TE METHOD TO CORRECT THIS HAZARD IS: A) The General Contractor will inform the structural engineer prior to placement of the steel lintels that the details as shown on the structural drawing could not be used due to the changed site conditions and the structural engineer will be requested to provide new details. Note: No abatement certification is required.
