Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.)An employee was observed operating a forklift truck without wearing a seatbelt thus exposing the employee to the hazards of serious physical injury or death. National consensus standard ASME B56.1-1993 requires the use of an operator restraint system when equipped on a powered industrial truck. A possible means of abating the violation would be to retrain and establish a means of accountability for employees concerning the importance of wearing seatbelts when operating industrial powered trucks. ABATEMENT VERIFICATION REQUIRED
