Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards created by a powered industrial truck (PIT) operator being intoxicated while driving the PIT around the jobsite. a.) On or about January 31, 2003, at the construction site located at the barricks' common area at 4420 Jackson Blvd.; Fort Jackson, SC 29207; the operator of a Clark Equipment - Electric Clarklift; Model # EC500-45F; S/N E355-0669-5397FA1084; Type-ES was intoxicated (Richland County, SC Coroner's Report showed: "0.171w/v Ethanol found in urine; 0.965 g/kg Ethanol found in brain; 0.327 g/kg Ethanol found in liver"). Among other means, one method of abating this hazard is the development, implementation and enforcement of an alcohol and drug prevention program that requires employee testing and daily observations and monitoring of employees for signs of possible intoxication.
