Text For Citation: 01 Item/Group: 002 Hazard: GUARDING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being shot by a .22 caliber rifle: a)Kill Floor, on or about 9/15/98: Safe gun handling rules were not being followed while a .22 caliber rifle was used to slaughter bovine. ABATEMENT NOTES: Among other methods, one feasible and acceptable method to correct this hazard is to: 1) Always keep the gun pointed in a safe direction. 2) Know the target and what is beyond it. 3) Ensure that the gun is safe to operate (no missing or broken trigger guards). 4) Wear hearing and eye protection as appropriate. 5) Store guns so that they are not accessible to unauthorized persons. 6) Follow the National Rifle Associations fundamental rules of gun safety. 7) Follow the gun safety rules set forth by the New York State DEC hunter education course. Abatement certification is required for this item.
