Text For Citation: 01 Item/Group: 002 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Employees working in the Wet Room were exposed to being struck by falling material from the roof that was in poor repair and falling onto the floor below. Large holes were present and decking, tar, gravel, and other debris had fallen onto the floor and were hanging from the roof in other areas of the Wet Room. Among other methods, a feasible and acceptable abatement method to correct the hazard is: 1. Repair the roof to a structurally sound condition; 2. Repair a portion of the Wet Room roof and eliminate exposure outside of the "repaired area"; 3. Eliminate the employee exposure to Wet Room by discontinuing the use of the area; and, 4. Remove the roof of the Wet Room. Disclaimers: a. The employer is not limited to the abatement methods suggested by OSHA; b. The methods explained are general and may not be effective in all cases; and, c. The employer is responsible for selecting and carrying out an effective abatement method.
