Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized health hazards, chemical and particulate exposure, associated with uncontrolled and inadequate respirator usage. Employees at the cattle yard are exposed to the hazards associated with respirator usage. Half mask respirators are used in the spray booth due to particulate and chemical vapor exposure and dust masks are used at the employees discretion throughout the rest of the facility due to dust, including grain dust, exposure. Among other methods, feasible and acceptable abatement methods to correct this hazard include, but are not necessarily limited to the following: a)Employer shall establish and maintain a respiratory protection program that includes the requirements outlined in Section 4.5 of American National Standards Institute (ANSI) Z88.2 - 1992. b)Employer shall establish an individual to be assigned the responsibility and authority for the administration of the respirator program as outlined in Section 5 of ANSI Z88.2 - 1992. c)Employer shall establish and maintain written standard operating procedures for respirator usage as outlined in Section 6 of ANSI Z88.2 - 1992. d)Employer shall provide adequate training to ensure the proper use of respirators as outlined in Section 8 of ANSI Z88.2 - 1992. e)Employer shall provide a qualitative or quantitative respirator fit test to determine the ability of each individual respirator wearer to obtain a satisfactory fit with a tight-fitting respirator as outlined in Section 9 of ANSI Z88.2 - 1992.
