Text For Citation: 01 Item/Group: 002 Hazard: CRUSHING

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed/struck by falling pieces of equipment: a) On or about 05/24/05, new waterline being installed on Pinnacle Road, soft bolts were used to affix the wrist/hinge/hoist pin to the arm of the Caterpiller excavator, Model 322B-L in lieu of proper pins or bolts as required by the manufacturer. b) On or about 05/24/05, new waterline being installed on Pinnacle Road, the wrist pin on the Caterpiller backhoe, Model 416-C, NY. license # Spec. Comm. 13537-SC did not have any pins or bolts in the end of the pin to keep the pin in place and prevent it from coming apart. c) On or about 05/24/05, new waterline being installed on Pinnacle Road, soft bolts were used to hold the wrist/hinge/hoist pin to the arm of the Caterpiller 416-D backhoe in lieu of the proper pins or bolts as required by the manufacturer. Among other methods , one feasible and acceptable method to correct these hazards is (1) to follow the Association of Equipment Manufacturers (AEM) "Safety Manual for Operating and Maintenance Personnel" whicch requires that damaged and missing parts are repaired or replaced, (2) To follow the Manufacturer's Operator Manual by using only service parts meeting manufacturer specification's, and (3) To train operators and maintenance personnel to inspect equipment for defects and to complete service and repairs before equipment is placed back in to service. ABATEMENT DOCUMENTATION REQUIRED
