29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access, or were not secured: (a) On or about September 17, 2025, the portable extension ladder being used to access the roof of the main residential structure did not extend at least three feet above the upper landing area and was not secured. This exposed employees accessing and egressing the roof to a fall hazard of 9-feet 10-inches. Bayron Alexander Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1821243, citation number 1, item number 4, and was affirmed as a final order on December 11, 2025, with respect to a workplace located at 1028 Arrowwood Ct. Pewaukee, WI. 53072.
