Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling scaffold from 60 ft. height: a) Centerre 21 Building, Hwy 270 and Hwy 21, single point suspension scaffold, i.e., Sky Genie Seatboard System, in use with a 1/2 inch diameter nylon rope to lower the employee on the seatboard as he cleans the windows, the rope was not inspected prior to use and was used beyond its manufactured recommended lifetime of 2 years. Among other methods, one feasible and acceptable abatement method to correct this hazard is to inspect all rope in use with the Sky Genie Seatboard System prior to each use and to downgrade or discard any rope that is damaged or that has been in use for over 2 years.
