OSH ACT of 1970 Section (5)(a)(1) The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or likely to cause, death or serious physical harm to employees in that employees were exposed to hazards related to the accumulation of dust: ... the employer did not provide for effective capture and control of dust generated during the operation of grain handling equipment. While the housekeeping program was implemented, the employer did not document the scheduled cleaning activities. Recommended Abatement Action: Among other methods, feasible and acceptable means of abatement to correct this hazard would be to establish, implement and enforce housekeeping program, policies, and procedures. Currently, there are no bins in operation at the Sunray location. If operations resume, Respondent will implement its housekeeping program.
