29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): On or about March 12, 2025, it was observed that employees performing material handling activities in buildings 3 and 4 of the Nebraska Warehouse Company, LLC located at 10064 South 134th Street, Omaha, Nebraska were exposed to struck-by and caught under hazards in that the employer did not remove defective powered industrial trucks from service. Instances included but were not limited to: i. Jungheinrich ETV 214 reach stacker, serial number 91095861, the previously installed seatbelt assembly was missing the seat belt strap rendering it inoperable, ii. Jungheinrich ETV 214 reach stacker, serial number 91073773, the previously installed seatbelt assembly was missing a buckle rendering it inoperable, iii. Jungheinrich ETV 214 reach stacker, serial number 91073772, the previously installed seatbelt assembly was missing a buckle rendering it inoperable, vi. Jungheinrich ETV 214 reach stacker, serial number 91061315, the previously installed seatbelt assembly was missing a buckle rendering it inoperable, and v. Jungheinrich RTV 214 reach stacker, serial number 91065332, the previously installed seatbelt assembly was missing a buckle rendering it inoperable.
