29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury. a) On or about March 10, 2025, at or about GPS coordinates 34.70018 degrees North, 86.76994 degrees West, on a jobsite in Madison, AL; workers were not trained to recognize hazards while working in excavations. b) On or about March 10, 2025, at or about GPS coordinates 34.70537 degrees North, 86.76755 degrees West, on a jobsite in Madison, AL; workers were not trained to recognize hazards while working in excavations. c) On or about March 10, 2025, at or about GPS coordinates 34.71333 degrees North, 86.76804 degrees West, on a jobsite in Madison, AL; workers were not trained to recognize hazards while working in excavations. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
