OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to crushing hazards while using deficient lever hoists: a) On or about January 27, 2025, and at times prior, the employer, Powdr - Copper Mountain LLC DBA Copper Mountain Resort, did not ensure lever hoists and their load suspension parts in maintenance shops for chair lifts including, but not limited to, the American Eagle, the American Flyer, and the Super Bee were inspected on a pre-operational and frequent basis when operated daily by employees. This condition exposed employees to crushing hazards. b) On or about January 27, 2025, and at times prior, the employer, Powdr - Copper Mountain LLC DBA Copper Mountain Resort, did not ensure the hooks on lever hoists used in maintenance shops for chair lifts including, but not limited to, the American Eagle, the American Flyer, and the Super Bee, were equipped with latches that bridged the throat opening of the hook for the purpose of retaining slings. This condition exposed employees to crushing hazards.
