29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): (a) 1955 W. North Ave., Melrose Park, IL 60161 - On or about January 22, 2025, the employer did not ensure that employees accessing levels of the Symbotic, LLC operated automated racking structure, at a height greater than 4 feet above the the respective zone floors in driveways were protected from falling from the unprotected sides or edges on the level they are accessing. Employees would access levels which were located at approximately 8 feet - 8 inches, and 5 feet - 9 inches in the respective zones with openings in-between each of the 5 charging pads installed in each level. (b) 1955 W. North Ave., Melrose Park, IL 60161 - On or about January 24, 2024, the employer did not ensure that employees on the transfer deck of level 11 in the Symbotic, LLC operated automated racking structure, at a height of 62 inches above the access platform were protected from falling from the unprotected edge of the transfer deck. Employees would access the transfer deck in order to collect robots that became unresponsive and take them to the driveways to be restarted. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
