Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with working while exposed to a 20-24 foot fall to the pavement below: (a) Employees traversing the steel structure of an elevated highway expansion, Eastbound on the Brooklyn-Queens Expressway were not provided with a means of fall protection, on or about 9/10/91. ABATEMENT NOTES: Among other methods, one feasible and acceptable abatement method to correct this hazard is to install stanchions and cables so that the company could then enforce the use of safety belts as prescribed in their safety program, or the company could install safety nets or its equivalent.
