29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: On or about June 10, 2024, the employer failed to identify and evaluate the respiratory hazards in the workplace, including a reasonable estimate of employee exposures to respiratory hazards, when employees on the powder line were exposed to various types of dusts including, but not limited to, calcined petroleum coke, natural graphite, and synthetic graphite. An employee was exposed to PNOR (total dust) that exceeded the PEL while operating the AC Mills on the powder line. No air monitoring or reasonable estimate of employee exposures to respiratory hazards had been completed.
