29 CFR 1910.110(f)(2)(i):Containers in storage were not located in an area that minimized exposure to excessive temperature rise, physical damage, or tampering from unauthorized persons: 865 Quaker Highway Uxbridge, MA 01569: On or about May 13, 2024, and continuing after for multiple days, the employer did not ensure that seven portable propane tanks kept in the maintenance work area were stored in a manner in which they were protected from vehicles that are driven in and out of the work bays, as well as foot traffic by any of the 14 maintenance and detail personnel that walk through the bay. Although the Area Office held a conference with the employer prior to issuing this citation and the others now being issued in this inspection, the issuance of these citations does not represent the end of the inspection. The inspection is still open, due to the employer's failure to comply with the subpoenas that OSHA issued and served during the inspection. The Acting Secretary of Labor has filed a petition for subpoena enforcement in the U.S. District Court of Massachusetts, as part of which the Asking Secretary has asked that the statute of limitations for OSHA to issue citations be tolled.
