Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of a confined space: a) C-2 Fixed Ammonia Still, Contaminated Water Treatment Plant. The employer failed to ensure that procedures and equipment necessary to rescue a disabled employee from the confined space were in place. A feasible method of abatement for these conditions would include the following: 1) Supplied air respirators approved for a IDLH atmosphere shall be provided for use in emergencies. 2) A written plan addressing the unique problems of egress from the ammonia still shall be developed and implemented. 3) Other rescue equipment that may be necessary such as body harnesses, ropes and a lifting device shall be made available.
