29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) On or about May 14, 2024, an employee working on the feed station inserting cheese panels onto the conveyor was exposed to noise at 154.1% of the permissible daily dose as measured over 567 minutes of sampling on a 10 hour shift. This dose is equivalent to an 8-hour TWA exposure of 130.3%. This dose is also equivalent to a 10 hour TWA exposure of 93.1 dB accounting for the 33 minutes unmonitored. The adjusted action level for a 10 hr shift is 83.4 dB. The average sound level measured over the sampling period was 91.9 dB. b) On or about May 14, 2024, an employee working in the clean in process room removing cheese panels off the conveyor was exposed to noise at 188.4% of the permissible daily dose as measured over 560 minutes of sampling on a 10 hour shift. This dose is equivalent to an 8-hour TWA exposure of 161.4%. This dose is also equivalent to a 10 hour TWA exposure of 94.5 dB accounting for the 40 minutes unmonitored. The adjusted action level for a 10 hr shift is 83.4 dB. The average sound level measured over the sampling period was 93.4 dB.
