Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.On or about May 17, 2000, the Michigan 275-B tractor shovel with highlift arms used in the marine terminal yard for loading bulk materials had brakes that were defective, the steering was loose, the throttle would stick and there were various hydraulic leaks in the lift jacks, exposing employees either operating or working in the vicinity of it to injury. Among other methods, one feasible and acceptable method of abatement is to develop and implement a program of inspection to include corrections of known and potential defects prior to reuse.s
