29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section: At a worksite located at or near 39.185939, -93.868953 in Lexington, MO: Employees were exposed to crystalline silica hazards in the performance of their job duties. The employer failed to fully and properly implement engineering controls, work practices, and respiratory protection specified for the task on Table 1. Further the employer did not assess and limit the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. This was last demonstrated on or about March 11, 2024, when employees were working to replace a sanitary sewer pipe inside a vault and employees used jack hammer to remove a section of concrete wall to access a valve and piping.
