29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. On February 12, 2024, on the north side of the construction site, employees using extension ladders that did not have the side rails extended three feet over the upper landing surface were exposed to potential fall hazards greater than six feet. a) Werner ladder located on the north side did not extend 3 feet above the landing, b) Werner ladder on the south side did not extend 3 feet above the roof landing, c) Werner ladder on the west side did not extend 3 feet above the roof landing. Eduardo Ruiz was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1658638, citation number 03, item number 001 and was affirmed as a final order on May 2, 2023, with respect to a workplace located at 2737 Acadia Drive, Corinth, TX 76210. This inspection is currently in collections at the U.S. Treasury with current penalties of $25,866.45.
