29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: On or about January 31, 2024 the employer Dayton Roofing and Restoration LLC at jobsite located at 137 E. Center St. Marion OH 43302, did not ensure the side rails of one portable Little Giant Multi-purpose ladder (S/N 21012S) was extended at least three feet above the landing surface. Two employees were exposed to falls from approximately 12 feet or greater from the top of the second (roof) level to the decking below while using the ladder to access the second (roof) level to perform commercial roofing repair activities on a commercial building.
